Police reported that at 12:18 a.m. Sept. 7, Delvasto was driving a 2006 Toyota on Highway 544 in Conway, South Carolina, when they say he struck Gorshack. Delvasto reportedly left the scene, but returned shortly afterward. Police said he was not injured.

Gorshack, 18, of Warwick, N.Y., died of massive head trauma at the scene, according to reports.

Gorshack had a blood alcohol content of .153, nearly twice South Carolina's legal limit of .08, according to WPDE News.

At the time of the incident, said WPDE, she was crossing the street heading to a local bar, Might As Well. The bar "closed voluntarily in November after discussions between CCU and the 15th Circuit Solicitor's Office," said the report.

Delvasto's next court date has not yet been reported.
